I had a bad car crash, not my fault, but I didnt have any insurance. Can i sue?

I was in a bad car accident (totally not my fault- the other driver got a ticket for running a stop sign). I didnt have any car insurance though (dumb I know) and got a ticket for that. I have multiple injuries requiring surgery. My health insurance covers some but not all and I'm missing work. Can I sue the other driver for injuries etc. even though I didn't have insurance? I live in a no-fault state. thanx

    Best Answer – Chosen by Voters Gota love it. If you had been the one at fault the other guy would be stuck because you didn't have insurance and I'm guessing not much in the way of assets to go after to cover his loss. And now you expect him to pay, what ever happened to the saying "do unto others as you would have them do unto you"?

    not a lawyer..but yes you can sue…theres a special insurance for the uninsured that the state or fed has… it might be in only certain states, but you are protected, insurance or not, you still have the right to sue, but it might hurt your case… but hey, if it is clearly not your fault, then you seem to have a good argument tooi would consult a lawyer though, im sure you can find one that could at least answer this question for free

    Insurance has nothing to do with your legal right to file a lawsuit for damages when someone injures you and/or your property. Many attorneys will give you a free consultation and let you know if they feel you have a good case.

    Yeah you better see a lawyer. If you sue the other driver, you will be going up against them and their insurance. They will argue that you never should have been on th road in the first place and put some blame back on you.

    I agree witch Daniel, If you looking compensation (payout) you will pay a ticket and then sue the other party. I would see legal advice ASAP.

    No fault, means that each insurance covers its insured party. I think you are on your own.
